These Terms & Conditions ("Terms") govern your use of LitMail's email outreach and deliverability platform (the "Service"). The Service is provided by LitMail ("LitMail", "we", "us"), and by using the Service you contract with LitMail. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. Acceptance of these terms

By creating an account or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You must be of legal age in your jurisdiction to use the Service.

2. The Service

LitMail provides a multi-mailbox email outreach platform for Gmail and Outlook, including campaign scheduling, mailbox rotation, personalization, deliverability warmup and monitoring, a unified inbox, and analytics. We grant you a limited, non-exclusive, non-transferable right to use the Service within the limits of the plan you select.

3. Acceptable use

You must not misuse the Service. You agree not to:

  • Use the Service for unlawful purposes, fraud, or to send spam or unsolicited bulk email in violation of applicable law (including CAN-SPAM, GDPR, and similar regulations).
  • Infringe intellectual property or privacy rights.
  • Interfere with the Service's security — including uploading malware, probing, scanning, or scraping the Service or its infrastructure.
  • Reverse engineer, resell, redistribute, or circumvent technical limits of the Service.
  • Send content that is deceptive, defamatory, or promotes illegal products or services.

You are responsible for the lawfulness of your prospect lists and the content of your campaigns, and for maintaining the confidentiality of your account credentials.

4. Intellectual property

LitMail retains all ownership of the Service and its intellectual property, including software, documentation, and branding. You retain ownership of your content; you grant us a limited license to host and process it solely to provide the Service.

5. Payments and subscriptions

Paid plans are billed as subscriptions on a monthly or annual basis. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms). Subscriptions renew automatically until canceled; you can cancel at any time and retain access until the end of your paid billing period. See our Refund Policy.

6. Service availability

We work hard to keep the Service reliable but do not guarantee uninterrupted or error-free performance. Deliverability outcomes depend on factors outside our control, including your sending practices and recipient mailbox providers.

7. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious violations of our acceptable use rules. When access ends, we may delete your data after a reasonable export window; you may request an export of your data before termination where feasible.

8. Warranties and liability

The Service is provided "as is" and we disclaim all implied warranties to the fullest extent permitted by law. To the extent permitted by law, we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill), and our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, death, or personal injury where such limitation is not permitted by law.

9. General

You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for delays caused by events beyond our reasonable control. These Terms are governed by the laws of the Philippines, and disputes will be resolved in its courts, unless mandatory local law provides otherwise. We may update these Terms from time to time; continued use of the Service after changes take effect constitutes acceptance.
